Construction Liens

As experienced construction lawyers at Aadvantage Legal Services, we care about building long-term relationships with our clients. Small-business owners, contractors, subcontractors, and others in the building industry, as well as property owners and consumers of construction services, rely on our attorneys’ knowledge of Michigan property lien law.

Assisting Homeowners Seeking Release of a Lien

Homeowners often contact us for assistance when they discover the existence of a previous construction or mechanic's lien on their property. These may have come about as a result of a subcontractor’s allegations of nonpayment for work completed. For such clients in Wayne County, Macomb County, or Oakland County, we work to obtain release of the lien through proper legal channels. We defend and advise property owners on their rights and obligations with regard to property liens.

Was the Lien Valid?

We investigate all details related to the placement of the lien on their property: was it valid? Was it filed in a timely manner? Sometimes we discover that a lien was not valid. In that case, we notify the person who placed it to release it, and advise them of the consequences for failing to release the lien as required by law.

Ensuring that Contractors’ Liens Result in Payment as Promised

Contractors also contact us for legal advice and representation regarding collections related to liens they have legitimately placed on a property. We advocate for these clients, to ensure that the appropriate parties are notified as required by law (by certified mail, for example). We also advise contractors who have not been paid for work completed on the procedures involved in filing a lien that will be enforceable.

In Pursuit of Quick, Efficient, Satisfactory Resolutions

Our goal with regard to contractor liens is the same as the ultimate goal of most of our clients: to avoid litigation. We support them in their efforts to collect on unpaid work, or to obtain release of invalid liens, in the quickest, most efficient way possible. Our clients of long standing trust our commitment to complete the jobs that they entrust to us accurately and economically.
